Terms and Conditions of Use

Introduction

This document is an electronic record under the Information Technology Act, 2000 and rules made thereunder, as amended by the Information Technology (Amendment) Act, 2008. It is generated by a computer system and does not require any physical or digital signature. It is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, read with the Consumer Protection (E-Commerce) Rules, 2020.

Accessing or using www.thesellpoint.com ("Website") means you ("User", "Buyer", or "Client") have read, understood, and accepted these Terms and Conditions ("Terms"). The Website is operated by Radical Retail Private Limited (CIN: U62013HR2026PTC141594), registered office at Khasra No. 34/22, Ground Floor, NK Tower, Kanhai Road, Sector-45, Gurugram, Haryana 122003.

1. Definitions

Buyer / Customer — a person purchasing products from the Website.
Seller — a person selling a device to us through the Website's buyback flow (see Section 5).
Products — new devices, refurbished devices, and accessories listed on the Website.
Services — Website access, listings, device evaluation and buyback, delivery, and after-sales support.
User — anyone using the Website.
Agreement — these Terms, together with our Privacy Policy, Returns Policy, and Warranty Policy.

2. Scope and Nature of Services

We sell new devices and accessories, sell inspected and refurbished used devices from our own stock, and buy used phones and laptops directly from consumers for refurbishment and resale. One account covers both buying and selling with us.

3. User Registration and Account Responsibilities

You must provide accurate contact details, keep your login credentials confidential, and are responsible for activity on your account. We may suspend or terminate an account used fraudulently or in breach of these Terms.

4. Buying From Us

Listings. Refurbished listings are one-of-a-kind — the photos and Condition Report on the product page describe the exact unit you would receive, graded and disclosed honestly, not a representative sample.

Pricing and payments. Prices shown include GST; every order gets a GST invoice. Payments are processed securely by Razorpay — we never see or store your card details ourselves.

Delivery. We currently deliver within Gurugram, Haryana 122001. Delivery timelines depend on product availability and our courier partner and are shown at checkout where available.

5. Refunds, Returns, and Cancellations

Orders can be cancelled before dispatch. Once delivered, our full return terms — including the 7-day return window and refund timing — are set out in our Returns Policy, which forms part of this Agreement. We may also cancel an order ourselves for reasons including stock unavailability, a pricing error, a failed payment, or suspected fraud, in which case any payment received is refunded.

6. Selling Your Device to Us

Eligibility. You must be the lawful owner of any device you submit, and able to provide valid identification where we ask for it as part of our verification process.

Accurate submissions. The information you give us about a device — including its condition and its IMEI/serial number — must be accurate. We do not accept devices that are stolen, counterfeit, reported lost, or subject to an outstanding finance agreement, and we reserve the right to decline or cancel a submission, and to report a suspected stolen device to the relevant authorities, where we reasonably believe this is the case.

Quotes, inspection, and payout. Quotes are manual — a person reviews what you tell us and confirms a price within 24 hours, valid for 72 hours once issued. Nothing is final until you accept. If, on inspection at pickup, your device doesn't match what you described, we'll offer a revised price on the spot — you can accept it or decline and keep your device, no obligation either way. Payment for accepted, inspected devices is made promptly — same-day for self-drop-off/self-pickup handovers, within 24–48 hours by bank transfer for third-party pickup or drop-off.

7. Warranty

New devices carry the manufacturer's own warranty on the manufacturer's own terms. Every refurbished device we sell carries our own warranty on top of that. The exact coverage, what it excludes, and how to claim it are set out in full in our Warranty Policy, which forms part of this Agreement. Where a claim is valid, our liability is limited to repair, replacement, or refund of the affected item — we are not liable for indirect or consequential losses.

8. Data Protection and Privacy

We process personal data in accordance with the Digital Personal Data Protection Act, 2023. What we collect, why, and your rights are set out in full in our Privacy Policy, which forms part of this Agreement.

9. Intellectual Property Rights

All trademarks, logos, and content on the Website belong to Radical Retail Private Limited or its licensors. Copying or redistributing them without permission is prohibited.

10. Force Majeure

Neither party is liable for a delay or failure caused by events beyond its reasonable control, including natural disasters, internet or power outages, strikes, or government action.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Courts in Gurugram, Haryana have exclusive jurisdiction. We ask that any dispute first be raised with our Grievance Officer (Section 13) so we can try to resolve it directly.

12. Modifications

We may update these Terms from time to time. Continued use of the Website after an update constitutes acceptance of the revised Terms.

By accessing, buying from, or selling a device to us through the Website, you acknowledge that you have read, understood, and agreed to these Terms, including the Returns, Warranty, and Privacy policies referenced above.
